Deputy Minister of Defense of Ukraine Anna Malyar told how to qualify the occupiers' crimes and get to the point where the perpetrators will be punished.
There is an exciting problem in international law. This is such hypocrisy and weakness of international law when, on the one hand, war, or the language of legal norms - aggression - is prohibited by international law, but on the other hand, there is a professional army, which is allowed to kill and shoot.
This was announced by the Deputy Minister of Defense of Ukraine, Anna Malyar on the air of "Breakfast with 1+1".
âIf we are talking about future criminal liability for this war, then we are talking only about the military-political command of the Russian Federation or any other country committing aggression. But we are not talking about the responsibility of subordinates â ordinary military who came here and kill here,â â she noted.
According to Malyar, international law established the rules and customs of war. That is, war is prohibited, and the rules and customs are established.
This is an atavism.
Ukraine has a chance to declare this to the whole world and say that this is how we will not end the war in this world.
âOr let every military bear responsibility, the aggressor who came here. Even if he did not rape. He just killed our military. There should also be responsible for this, and there is no such responsibility in the world today,â she stressed.
Also, according to Malyar, the concept of "execution of a criminal order", when we talk about aggression, also applies only to the military-political leadership. This is written in the Roman statute.
âNot a simple military man who came here to kill us. Of course, according to the rules and customs of war, military men can be killed,â she explained.
The deputy minister explained that if civilians are killed, responsibility already arises for this: there is the concept of war crimes, crimes against humanity.
âBut, if we want to end the war in the world, then every military man should know that if he goes here or to another country, he must answer ⦠The world is weak and cannot be held accountable for aggression,â Malyar concluded.
