Today, the government made a decision to allow foreign companies and organizations operating in Ukraine through separate subdivisions and permanent representations to obtain the right to engage in construction activities.

The relevant changes are being made to the CMU Resolution No. 314 dated March 13, 2022. These changes pertain to the construction of facilities classified as medium (SS2) and significant (SS3) impact objects.

The right to conduct construction activities will be granted through the free submission of a declaration of business activity to the licensing authority, without the need for a construction license.

This provision will be in effect during the state of martial law.

The draft act was developed by the Ministry of Economy in accordance with the protocol decision of a special meeting chaired by Ukraine's Vice Prime Minister and Minister for Reintegration of Temporarily Occupied Territories Iryna Vereshchuk.

The approval of this act will improve the regulatory framework for foreign companies in Ukraine. In particular, it will enable Polish company representatives in Ukraine to carry out works related to the development of border crossing points on the Ukrainian-Polish border.

Such works are planned as part of the implementation of the Agreement between the Government of Ukraine and the Government of the Republic of Poland on providing credit under the terms of tied aid, dated September 9, 2015.
