Alexandr Tupitsky can be extradited from Austria. The court also ruled that the amount of bail, which the Ukrainian judge previously paid, should go to the State.


The court chose the ex-chairman of the Constitutional Court of Ukraine, Aleksandr Tupitsky, as a measure of restraint in the form of detention.

The State Bureau of Investigation reports this.

"The court chose a preventive measure in the form of detention for the former chairman of the Constitutional Court of Ukraine, which allows him to apply for his extradition from Austria," the message says.

At the same time, it is noted that the Podolsky District Court made such a decision of Kyiv.

"By the same court ruling, the amount of bail previously applied to the accused was turned into State revenue," the SBI noted.

It is worth recalling that, according to the materials of the Bureau, on May 27, 2022, the ex-Chairman of the Constitutional Court was put on the international wanted list, so this court decision allows the prosecution to petition the court for the extradition (extradition) of the accused to Ukraine.

It is also indicated that on May 25, 2021, investigators from the State Bureau of Investigation, under the procedural leadership of the Office of the Prosecutor General, sent an indictment against Tupitsky to the court.

Tupitsky is a defendant in several criminal proceedings, in particular, on bribing a witness; on the provision of false testimony in the case of the seizure of property assets of the Zuevsky Energy Mechanical Plant, as well as on the illegal use of the key for the electronic signature of payment documents of the Constitutional Court.

In particular, in October 2018, the defendant, in the interests of his acquaintance, the former Chairman of the High Economic Court of Ukraine (wanted), bribed a witness to refuse to testify or give deliberately false testimony in criminal proceedings related to the seizure of the assets of CJSC Zuevsky Energy Mechanical Plant

In addition, according to the investigation, during 2018-2019, the accused repeatedly, for mercenary motives, provided the investigator of the General Prosecutor's Office of Ukraine in the same proceedings with deliberately false testimony, combined with the artificial creation of evidence for the defense in relation to a severe crime.

The ex-Chairman of the Constitutional Court is accused of giving knowingly false testimony, combined with the artificial creation of evidence for the defense (part 2 of article 384 of the Criminal Code) and bribing a witness to give knowingly false testimony (article 386 of the Criminal Code of Ukraine).

If found guilty, the defendant faces a sentence of imprisonment for up to 5 years.

In April 2022, the SBI reported that Tupitsky had fled to Austria. After that, he was put on the international wanted list.
